We are Golden Eye Hospitality, LLC (“Company,” “we,” “us,” or “our”), a company located in Georgia, United States.
We operate the website GEHManagement.com and any related pages, forms, content, features, or services that refer or link to these Terms and Conditions, collectively referred to as the “Services.”

12. Dispute Resolution
Informal Negotiations
To expedite resolution and control the cost of any dispute, controversy, or claim related to these Terms and Conditions, the parties agree to first attempt to negotiate any dispute informally for at least thirty (30) days before initiating arbitration or legal proceedings.
Informal negotiations begin upon written notice from one party to the other.
Binding Arbitration
If the parties are unable to resolve a dispute through informal negotiations, the dispute may be resolved by binding arbitration, unless otherwise prohibited by law.
Any arbitration shall be conducted under the rules of the American Arbitration Association, where applicable

Unless otherwise required by applicable law, arbitration shall take place in Georgia.
You understand that, without this provision, you may have the right to sue in court and have a jury trial.
Restrictions
To the fullest extent permitted by law:

No arbitration shall be joined with any other proceeding;

No dispute shall be arbitrated on a class-action basis;

No dispute shall be brought in a representative capacity on behalf of the general public or other persons.
Exceptions
The following disputes are not subject to informal negotiation or arbitration requirements:

Disputes seeking to enforce or protect intellectual property rights;

Disputes involving theft, unauthorized use, piracy, or invasion of privacy;

Claims for injunctive relief.
If a dispute proceeds in court rather than arbitration, the parties consent to the jurisdiction and venue of state and federal courts located in Georgia, unless otherwise required by law.
13. Corrections
There may be information on the Services that contains typographical errors, inaccuracies, or omissions, including descriptions, availability, market information, investment information, or other content.
We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information on the Services at any time without prior notice.

By providing your mobile phone number and opting in to receive text messages from Golden Eye Hospitality, you consent to receive SMS text messages from us regarding business-related communications, responses to inquiries, investment inquiries, partnership discussions, development matters, vendor communications, or other communications related to our Services.
Message frequency may vary.
Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
You may opt out of receiving SMS messages at any time by replying STOP. After you reply STOP, you may receive a confirmation message, and we will no longer send SMS messages unless you opt in again.

22. Miscellaneous

There is no joint venture, partnership, employment, or agency relationship created between you and Golden Eye Hospitality as a result of these Terms and Conditions or use of the Services.
You agree that these Terms and Conditions will not be construed against us merely because we drafted them.
You waive any defenses you may have based on the electronic form of these Terms and Conditions and the lack of signing by the parties to execute them.
